Privacy Policy
This document contains the privacy policy that applies when you as an employer or candidate use the services of Dutch Remote. Dutch Remote V.O.F. is responsible for processing privacy-sensitive information according to this privacy policy. The privacy policy contains a description of how Dutch Remote deals with privacy sensitive information of employers and candidates, for which purpose Dutch Remote collects, saves and processes these data and how Dutch Remote collects, saves and processes these data. Dutch Remote complies with the applicable laws and regulations.
We realize that our privacy policy is comprehensive. However, we want to properly and clearly explain to our clients (employers and candidates) how we comply with applicable laws and regulations. This entails asking employers, other users and candidates to take careful note of our privacy policy. Each time you as an employer, other user or candidate use DR’s internet site or access the employer or candidate profile you have created within DR’s internet site, you are deemed to have read and accepted the privacy policy.
If you as an employer, other user or candidate cannot accept our privacy policy do not use the services offered on DR’s Internet site.
DR may revise the privacy policy at any time. The new revised version will be posted on DR’s internet site. We recommend that you regularly inform yourself of our privacy policies (including in the event of changes) because they apply at any time when you use DR’s internet site as an employer, other user or candidate and/or log into the employer or candidate profile on DR’s internet site.
Below is the privacy policy observed by Dutch Remote:
Article 1: Applicability of privacy policy
1.1 This privacy policy applies to employers and other users and candidates who wish to use all services provided by DR on its website and all other DR Internet sites accessible through sub-level domain names related to this domain name. Also, this privacy policy applies to the employer or other user and candidate who creates or has created a profile on DR’s Internet site or logs into it.
1.2 The employer or other user and job seeker/candidate will be actively asked to read and accept the privacy policy when creating a personal profile. By accepting the privacy policy the employer or other user and job seeker/candidate declares to have read the privacy policy and to fully agree with it.
1.3 If the employer or other user or candidate does not fully accept the privacy policy, the employer or other user or candidate cannot use the services offered by DR on its Internet site, and cannot create an employer or candidate profile. As a result, the employer or other user cannot post vacancies and the candidate cannot respond to vacancies. Any further use of DR’s services is therefore strongly discouraged in that case.
1.4 The services offered by DR on its internet site to employers and other users and candidates are subject to the general terms and conditions for employers and the user terms and conditions for candidates, respectively. This privacy policy contains, in addition to the foregoing, the purpose for which Dutch Remote collects, stores and processes the data requested in the general terms and conditions of use and the manner in which the data are collected, stored and processed.
1.5 The purpose for which Dutch Remote collects, stores and processes data depends on the way in which you as a client use Dutch Remote’s services. A distinction is made between employers and other users and candidates.
1.6 Dutch Remote will request, collect, record, store and process only the data necessary to provide our services. Our services are focused on offering remote and hybrid jobs on our internet site and we want to contribute to employers being able to fulfill their need for qualified personnel. We also want to help candidates find an attractive job that suits them so that they can take charge of their working life and personal development and growth.
Article 2 Definitions
2.1 In this privacy policy, the following definitions are used:
Dutch Remote: Dutch Remote V.O.F., established in Zeewolde, registered under the Chamber of Commerce number: 84128275 further referred to in these terms of use as DR.
Client: any employer or other user see on behalf of himself or another one (1) or more of DR’s standard packages offered on the internet site, purchases or with whom a written agreement has been entered into contrary to the standard packages offered on DR’s internet site.
Candidates: The natural persons who are looking for a new job (as an employee), internship (as a trainee) or assignment (as a freelancer or ZZP’er). In the remainder of these Terms of Use, job seekers and/or candidates are referred to as “candidates”.
Internet Site: the portal opened by Dutch Remote on the Internet and accessible to employers, candidates and other interested parties via www.dutchremote.com and all other DR Internet sites accessible via sub-level domain names related to this domain name.
Employer Profile: Employers and other users are offered the opportunity to create a personal account on the DR website. Only the creation of a personal account allows the employer or other user to create and publish job postings on Dutch Remote’s Internet site.
Candidate Profile: Candidates are offered the opportunity to create a personal account on the DR website. Only the creation of a personal account allows the candidate to respond to job postings published on DR’s Internet site by employers.
Article 3 Purpose of data collection
3.1 DR collects data from clients and candidates in order for them to be able to use the services DR offers on its internet site. In doing so, DR explicitly seeks the consent of clients and candidates. By collecting and recording data from clients and candidates, we enable clients to post vacancies quickly and efficiently and offer candidates the opportunity to quickly and efficiently get in touch with clients and/or apply for vacancies published by clients on DR’s internet site without having to enter the same data multiple times. This is because speed of posting vacancies by employers and responding to them by candidates is imperative within the tight labor market.
3.2 In the event clients and candidates visit the website and/or use DR’s services, DR also collects data on the IP address of clients and candidates as well as the internet site and page visits of clients and candidates for the purpose of properly tailoring the content of the internet site to the needs of clients and candidates.
Article 4 Data requested from clients
4.1 DR requests clients, when creating a personal account and thereafter when managing the account and filling out the contact form, to provide data that will help clients to post vacancies quickly and efficiently and get in touch with suitable candidates. DR also requests data that enables DR to establish and maintain contact with clients.
4.2 DR requests clients to provide data for the purpose of:
- Allow clients to use DR’s services and/or purchase products offered by DR;
- Provide candidates with an understanding of who the client is and what, among other things, is the nature of the client’s industry and (scope of) business activity;
- To forward candidate responses and candidate applications to the client;
- To make posting jobs as easy as possible, and not having to provide the same information repeatedly;
- To keep abreast of developments within the palette of services and products DR offers and to respond to questions from our clients;
- To further improve the Internet site in terms of functionality and user experience;
- Monitor use of the Internet site in order to ensure and further improve the security of the Internet site and detect possible fraud and abuse;
- Charge fees associated with purchasing services from DR;
- Get in touch with client representatives regarding any questions regarding the job posting/published, expressions included in job postings and/or questions regarding payment for services and products provided by DR.
4.3 In line with what is included in the previous article, DR requests (representatives of) clients to provide the following information:
- Company name;
- Description of business activity;
- The industry in which the company operates;
- Indication of the number of employees working within the company;
- Company logo (not required);
- Company video and/or video message from the recruiter (not required);
- Chamber of Commerce number;
- The VAT identification number;
- Address, zip code, place of business and country;
- Phone number;
- URL of the company’s website;
- Address on LinkedIn, Facebook and Twitter (not required);
- Name, last name, phone number and email address of the contact person with respect to the job posting/published;
- Name, last name, phone number and email address of the contact person with respect to the purchased standard subscription or with respect to the (customized) offer or accepted offer issued by DR.
4.4 If there is contact between the client or a representative on behalf of that client and DR (verbal, telephone, email or otherwise), DR may also collect and record data about the person with whom contact has been made with the purpose of being able to re-establish contact in the future.
Article 5 Information requested from candidates
5.1 DR requests candidates, when creating a candidate profile and subsequently when managing the candidate profile, to provide data that will help enable candidates to send responses and applications to clients in response to vacancies published by clients on DR’s internet site. DR also requests data that will enable DR to establish and maintain contacts with candidates.
5.2 DR requests candidates to provide data for the purpose of:
- Allow candidates to use DR’s services and/or purchase products offered by DR;
- To provide the ability to upload a resume or manually create resume and also upload an elevator pitch;
- To be able to send responses and job applications to the clients who have posted vacancies on DR’s internet site;
- To be able to receive email alerts in response to job openings published by clients on the Internet site that have similarities with the candidate’s stated preferences and/or resume;
- Making responding to job postings as easy as possible, and not having to provide the same information repeatedly;
- To keep abreast the developments within the palette of services and products DR offers and to respond to candidate inquiries;
- To further improve the Internet site in terms of functionality and user experience;
- Monitor use of the Internet site in order to ensure and further improve the security of the Internet site and detect possible fraud and abuse;
- Get in touch with candidates regarding any questions regarding the job posting to be published, expressions included in job postings and/or questions regarding payment for services and products provided by DR.
5.3 In line with what is included in the previous article, DR requests candidates to provide the following information:
- First name, initials, middle name and last name as well as any title;
- Date of birth;
- Country of origin;
- Address, zip code, house number, city name, county;
- Email address (private);
- Phone number (mobile and/or landline);
- Details of preferences that a new job/assignment/internship should meet;
- Details of skills, previous work experience, portfolio, areas of expertise, knowledge of languages and honors and/or awards;
- Data on training/training and courses taken;
- Optionally, the candidate may choose to add an elevator pitch in which the candidate presents himself or herself in addition to what is included in the resume.
5.4 If there is contact between a candidate and DR (verbal, telephone, email or otherwise), DR may also collect and record data about the person with whom contact has been made for the purpose of reconnecting in the future.
Article 6 Understanding the data provided
6.1 Clients and candidates can view and retrieve the data they have provided at all times via the employer or candidate profile they have created. This is also the place where employers and candidates can change previously provided data at any time so that the data provided are correct and complete at all times.
6.2 If client or candidate decides to no longer use DR’s services and therefore wishes to delete the employer or candidate profile created, this can be done by choosing “Delete Profile” within the profile. All data recorded in the profile by client and candidate will then be deleted.
Article 7 Duration of data retention
7.1 Data of clients and candidates will be kept for the period that the client or candidate wishes to use DR’s services and the client or candidate has not decided to delete the profile created. If the collected data no longer contribute to the purpose for which the data were collected (see art. 3.1 and 3.2) DR will proceed to delete the collected data recorded in the employer or candidate profile.
7.2 With respect to the deletion of collected data, DR will at all times comply with what is prescribed in applicable laws and regulations.
7.3 If clients and candidates do not use the employer or candidate profile that has been created during the 1-year period, DR will request by email to indicate whether or not the profile should be kept. If the client or candidate indicates that the data provided and kept in the profile should no longer be kept by DR, DR will proceed to delete the profile and thus the data provided. If there is no response from the client or candidate, DR will again request via a (second) email to indicate whether the data should be retained. In the absence of a response to this second request, DR will proceed to delete the profile and thus the data provided.
Article 8 Security of retained data
8.1 DR has taken measures so that the data of clients and candidates included in the profile created are kept securely and protected against improper use by third parties. These measures include the fact that access to the profile can only be obtained by entering a user name and password. This prevents improper use or misuse of client and candidate data.
8.2 DR advises clients and candidates not to provide third parties with the username and password used to access the profile created. In this way, third parties cannot misuse data and make undesirable changes to it. Should the client or candidate have the impression, or be certain, that the user name and password have come into the hands of third parties without their consent, the password must be changed immediately.
8.3 DR uses, among other things, firewalls and encryption to protect and secure client and candidate data.
Article 9 Third-party data processing
9.1 DR uses the services of third parties where it concerns the construction and (if necessary daily) maintenance of DR’s Internet site. In addition, this third party provides the following services to DR or assists with DR’s work below:
- Website hosting;
- Collecting statistics on website visit and browsing behavior of website visitor.
- Send mailings to potential customers of DR;
- Making suggestions to improve the Internet site.
9.2 With regard to the secure and protected processing of personal data DR has entered into a processor’s agreement with the external processing party. This sets out the agreements relating to the storage and processing of data of both clients and candidates.
Article 10 Sharing your data with companies and other users
10.1 DR does not share candidates’ data with other companies and other users (including, among others, recruiters) except in cases where the candidate has given his or her own consent.
10.2 The sharing of data with other companies and recruiters will only take place after the candidate has given consent. Consent is given by (a) sending a response to a client (being an employer or other user) or (b) applying in response to a vacancy published by an employer or other user or (c) when the candidate has indicated that the CV and other data may be included in the CV database accessible to clients who have published vacancies on DR’s internet site.
10.3 In case of sending a response to the client or applying for a vacancy published by the client, DR shares the personal data provided by the candidate.
10.4 In the event that candidate data is shared with the client, the client is responsible for complying with its own privacy policy upon receipt. The client is considered the data controller upon receipt of candidates’ data. DR is neither responsible nor liable for client’s privacy policy or client’s application of or compliance with it.
10.5 In the event that the client refers on DR’s internet site to vacancies on other internet sites (for example, those of the client itself or those of other users), DR is not liable for the content of those internet sites and the way in which those internet sites make use of the candidate’s personal data.
10.6 Clients are not permitted to use and store candidate data other than for purposes of filling a vacancy.
10.7 In the event of a merger and/or acquisition of DR’s business, DR reserves the right to transfer the data collected by DR to the acquiring entity. In doing so, the laws and regulations regarding privacy-sensitive data will be observed as well as this privacy policy.
Article 11 Social Media
11.1 DR will post job alerts on social media channels (such as LinkedIn, Facebook and Twitter, among others). When candidates or clients share or like posts on social media channels, personal data may be received by DR. This data is not stored, processed or used by DR for any purpose.
11.2 The use of social media channels is subject to the general terms and conditions, terms of use and privacy policies of the providers of those social media channels. Both clients and candidates must inform themselves of these. DR is not liable for the quality or application of the general terms and conditions, terms of use and privacy policies of the providers of these social media channels.
Article 12 Charitable donations
12.1 In addition to providing quality services to candidates, DR places great importance on supporting charitable organizations assessed and/or possibly recognized by, among others, the agencies Givewell, ACE, Founders Pledge, (see website: doneereffective.nl), the CBF (Central Bureau on Fundraising) or Goede Doelen Nederland. To support these organizations, DR makes a portion of its income from the placement of job openings by employers available to DR-selected charitable organizations. Neither the candidate nor the client is asked to contribute in any way. DR announces its selected organizations through its internet site.
12.2 The client and candidate has influence in the choice of charitable organizations to which DR donates. Within the employer and candidate profile, the client or candidate may indicate a preference as to how DR donates to charitable organizations. If no choice is indicated, DR reserves the right at all times to make its own choices in the charitable organizations to which DR donates.
12.3 DR will not use preferences specified by the client and candidate other than to calculate the ratio DR will apply when making donations to charitable organizations. DR shall in no way publish data regarding the stated individual preferences of clients and candidates on its internet site or otherwise share such data with third parties.
Article 13 Changes to the privacy policy
13.1 DR may amend this privacy policy, which will be made known by publishing a new version on the internet site. We request that clients and candidates regularly consult the internet site and become aware of any changes to this privacy policy. Changes made will at all times be in accordance with the (then) applicable laws and regulations.
Article 14 Complaints
14.1 Complaints regarding privacy policies and/or DR’s application of or compliance with them should be reported by the client and/or candidate to DR by email or in writing. DR requests the client and/or candidate to describe the complaint in as much detail as possible so that DR is able to respond adequately. If a complaint is well-founded, DR will adjust its privacy policy accordingly as soon as possible.
Article 15 Applicable law and disputes
15.1 All possible disputes arising from this user agreement will be settled exclusively by the competent court.
15.2 DR and the candidate agree to make every effort to resolve a dispute prior to submission to the competent court in a manner acceptable to both parties.
